Vizio, Inc. v. Navigators Insurance Company & Arch Insurance Company
Vizio Consumer Privacy MDL
The latest news comes after VIZIO enters into a settlement agreement to end the allegations that it profited off of its customers’ private information without asking for prior permission.
It is noteworthy that the maker of smart TVs and other electronic devices was sued by its clients after it purportedly sold their data without seeking consent. The case ended up being consolidated into one multidistrict litigation (MDL) case, and the litigation became known as the Vizio Consumer Privacy MDL.
Nevertheless, VIZIO ended up agreeing to pay $17 million to seal a settlement deal and end the legal action launched against it.
Insurer Fights Back
Now, the consumer electronics business’ insurance company is arguing that it should have been informed beforehand of its involvement in the abovementioned settlement agreement.
Also, it details that it has already spent around $27 million in relation to the MDL. With regards to whether it should help VIZIO with the settlement, a court ruled out responsibility.
As a clap back, VIZIO contends that it is not required to disclose insurance-related concerns covering the settlement. Further, it retorts that details about the Vizio Consumer Privacy MDL have been relayed to Arch Insurance Co.
Lastly, it is said that the insurance company did not properly communicate with VIZIO nor conduct its own internal investigation regarding the subject.
Consider The Consumer will continue to report on this case as soon as updates are released to the public.
