Energizer AA Battery Class Action – False Advertising Leads To Lawsuit

Energizer AA MAX Batteries Are Not Long-lasting As Advertised – Lawsuit Filed By Disappointed Consumer

A class action lawsuit alleges Energizer’s AA MAX Batteries do not last as long as they were advertised. 

The plaintiff, Eduard Skylar, has contended that the Energizer company has tricked its customers, through different means, into believing that their Energizer AA MAX Batteries product lasts way longer compared to other batteries offered by competitors in the market. 

The lawsuit stems from the language the company uses to advertise its AA MAX Batteries product. 

In a report on Top Class Actions, the lawsuit has particularly pinpointed the marketing terms used, such as the company’s claims that its Energizer AA MAX batteries last up to 50% longer than basic alkaline demanding batteries.

The vague and broad meanings are to make the consumers think they are getting a battery product that lasts 50% longer than other brands, yet the truth is another different story. 

Skylar’s lawsuit claims that this is entirely false, for when tested and compared amongst competing products from other companies, the Energizer AA MAX batteries fail in comparison to other batteries. 

The test mentioned above uses the different established American National Standards Institute (ANSI) battery discharge testing standards. 

These findings Skylar cites on their lawsuit seem to point out a scientific backing to the claims made against the company that makes Energizer AA MAX batteries. 

Additionally, the lawsuit claims that the longevity of an Energizer AA MAX battery product depends on the place where it is manufactured. 

Energizer reportedly has manufacturing plants in various locations in the United States, Singapore, and Thailand. 

Skylar adds that batteries manufactured outside the US have shorter battery life than those made within the country. 

The lawsuit is filed in the US District Court for the Eastern District of New York. 

It seeks to make Energizer Brands LLC, the company behind the Energizer AA MAX batteries, liable for their misdeeds and to pay up actual, punitive, and statutory damages along with other fees.
