What You Should Know About The Spartan Mosquito Repellant Class Action Lawsuit
You may have heard about it in the news or read about it through your social media account but there’s so much more to know about the class action lawsuit filed against the maker of Spartman Mosquito Eradicator, a popular anti-mosquito product that is available in your local grocery and home improvement store and even online. - It was filed by a man from New York City.
Who is the person behind the class action lawsuit filed against Spartan Mosquito Eradicator, specifically, its maker, and lab partner, you may ask? That would be Todd Consolazio which hails from Manhattan. He’s heading a class action lawsuit against the makers of the known mosquito repellent product based in Mississippi.
According to Dean Balsamini of the New York Post, the plaintiff Consolazio had bought the said product from a local Lowe’s store located in Manhattan for its supposed claims. These claims include but are not limited to statements that the product “eradicate[s] your mosquito population for up to 90 days” and it “provides “do-it-yourself mosquito control”. However, they didn’t find any pleasing results from using the product, refuting that the product is a “complete scam” in the suit’s official court filing.
- The Plaintiff is seeking more than $5 million from the defendants.
The suit which was filed May 4 of this year in the United States (U.S.) District Court for the Southern District of New York charges AC2T, Inc., Bonner Analytical Testing Co., and Jeremy Hirsch of violating the Magnuson-Moss Warranty Act. Other violations include fraud, breach of express warranty, unjust enrichment, and false advertising.
It is reported that Consolazio is seeking more than $5 million in damages.
- The company is also facing a similar, yet separate, lawsuit.
In fact, it was also filed in the state of New York too!
Plaintiff Kalman Rosenfeld has filed a lawsuit against the company and its partner laboratory in the US District Court for the Eastern District of New York. Filed late September of this year, the nature of the suit is fraud or truth-in-lending. The case is being presided over by Judge Peggy Kuo and will be heard by a jury as demanded by the plaintiff.
- The maker of Spartan Mosquito Eradicator has sued someone that has been a vocal critic of the product.
AC2T, Inc., the company behind the Spartan Mosquito Eradicator, has not been keen with people who have been critical of their product. In fact, they have sued a former biology professor, Colin Purrington, for their negative statements about the aforementioned product.
Defendant Purrington was asked by the company’s suit to dish out $75,000 in damages, as well as interests, costs, attorney’s fees, and punitive damages as reported on the website Hattiesburg America. It is also asking Purrington to stop further sharing defamatory statements and to retract their previous statements.
