WellPet’s Complete Health and Core Pet Foods Not Actually Grain-Free, Contains Gluten – Class Action Lawsuit
The maker of WellPet’s Complete Health and Core products is being taken to court with a class action lawsuit alleging that the company has mislabeled the products above at the customers’ expense.
Filed in the United States (U.S.) District Court for the District of Massachusettes, the lawsuit revolves around the claims that WellPet LLC, the company behind the contended WellPet’s Complete Health and Core products, is making a false claim when they put in the product’s label that it is “Grain-Free” when in fact it is not.
According to independent testing presented by the plaintiffs to the case, WellPet LLC’s WellPet’s Complete Health and Core Product lines contain a “significant [amount of] gluten content.”
Thus, the class action adds that the pet food company has misrepresented its pet food products’ actual contents on its product labeling.
This is evident with the company’s assertions in WellPet’s Complete Health and Core products’ labels – words such as “Grain-Free” and “100% Grain-free” placed in prominent and easily recognizable areas of the front label for the customers to see.
Why is this so important? The plaintiffs to the lawsuit argue that some customers prefer pet food products that come with little to no grains in them, for they believe that it would be a much more nutritious meal for their furry friends.
“Grain-free pet foods are desired by consumers who believe that dogs and cats require pet foods that contain more protein and animal fats and fewer carbohydrates than grain-based pet foods,” the class action’s official filing said.
Thus customers who are trying to avoid such products end up buying them instead, in this case, any of WellPet’s Complete Health and Core pet food products, because of the misrepresentations made by its maker.
In addition to allegations of misrepresenting its products’ actual gluten content, the lawsuit claims that WellPet LLC is misleading its customers of how its products are top quality and undergo strict manufacturing compliance standards.
The class action lawsuit in Massachusetts is seeking to form and represent a nationwide Class of customers who bought any of WellPet’s Complete Health and Core pet food products that are allegedly mislabeled as “grain-free.”
Also, the formation of Subclasses of customers from the states of Washington, New York, New Jersey, Missouri, Minnesota, Michigan, Massachusetts, Illinois, Florida, and California is being proposed.
