Viagogo Fights to Avoid a Refund Refusal Nationwide Class Action Lawsuit
Viagogo, a ticket marketplace platform, is battling to avoid nationwide certification of a class action lawsuit alleging it failed to provide refunds for events scheduled during the pandemic.
According to Complete Music Update, Florida resident Lauren Shiflett filed a motion last month to expand her class action lawsuit against Viagogo from Florida residents alone to a nationwide Class. However, Viagogo responded to the motion by filing paperwork arguing that the court should deny the said request.
Shiflett claims she purchased two Tool concert tickets through viagogo.com, believing that the company would fulfill its “Viagogo Guarantee” and offer her a refund in the case of a cancellation.
However, Shiflett alleges that after the Tool concert and thousands of other events were canceled due to the COVID-19 pandemic, the company unjustly avoided fulfilling its refund commitment.
Shiflett contacted Viagogo and was informed that Viagogo is unable to refund ticket orders once they have been placed. All forms of redress are non-transferable and non-refundable.
The Class Action Lawsuit
The Viagogo Refund Class Action Lawsuit contends that Viagogo’s action is in direct violation of the company’s stated policy.
Viagogo is charged with breach of contract, unjust enrichment, and violations of Florida’s Deceptive And Unfair Trade Practices Act. It states that one of the site’s key features, and the reason buyers prefer it to other secondary marketplaces, is the “Viagogo Guarantee.”
According to reports, this guarantee ensures that customers will receive a full refund for their purchased tickets if an event is canceled. Moreover, this appears to have been Viagogo’s policy for an extended period.
However, according to Complete Music Update, Viagogo’s most recent filings indicate that buyers having tickets to pandemic-affected events have been handed vouchers worth 125 percent of the original purchase price.
The court would need to determine which Class members would choose the voucher over a cash return as per the company. It asserts that Shiflett did not adequately analyze the effect of state laws on a nationwide Class.
According to Viagogo, the court should conduct a rigorous analysis to determine whether the plaintiff accomplished her evidentiary burden in establishing the appropriateness of class treatment.
Furthermore, users of Viagogo in the United Kingdom have also reported similar issues in requesting refunds for tickets acquired through Viagogo following the cancellation of events due to the pandemic.
