A latest class action filing is accusing alcoholic beverage company Boston Beer Company of allegedly tricking its customers into believing that their Truly Hard Seltzer product is made out of black cherry fruit.
California Class Action Litigation Sues Beer Company For False Advertising Charges
Filed in a California court, the Truly Black Cherry Hard Seltzer Class Action Lawsuit is accusing Boston Beer of using false advertising schemes in relation to its Truly Hard Seltzer drink.
Plaintiffs James Kelly and Tatiana Galvez complained that the company’s Truly Black Cherry Hard Seltzer beverage offering does not have any black cherry in its ingredients at all. The two claimed that instead, the company only uses synthetic materials and substances to give their product a fruity flavor.
The class action retorted that the Boston Beer Company allegedly did not follow the law by failing to declare their Truly Black Cherry Hard Seltzer drink product as only a flavored drink and not a naturally-flavored product.
One of the plaintiffs shared that they truly believed that they are consuming a drink product that contained black cherries on its ingredients due to the imagery and statements made on the package labeling. Yet, as they found out, their expectations were untrue.

The Truly Black Cherry Hard Seltzer Class Action Lawsuit is taking Boston Beer Company to court for different charges, including false advertising, violations of various California and New York state consumer protection laws, and others.
Plaintiffs Kelly and Galvez are seeking to form and represent a Nationwide Class with a separate Class group for the states of California and New York each.
