Sanderson Farms Class Action; False Advertising
A recent Sanderson Farms Lawsuit is challenging the company’s marketing of chicken products, which are claimed to be 100% Natural. The pending Sanderson Farms Class Action, filed in the Northern District of California, alleges that chicken claimed to be 100% Natural by Sanderson Farms, Inc. is actually being improperly advertised.
The case’s complaint highlights claims by Sanderson such as: “There’s only chicken in our chicken. Seriously.” or “No additives or artificial ingredients. Not ever.” And “That means no additives, no unpronounceable ingredients, nothing extra. Just 100% natural chicken that’s healthy and a treat for your taste buds.”
There is also discussion of ad campaigns such as the Bob and Dale television commercials, or in print advertising which give consumers the perception that Sanderson Chicken products are 100% natural and/or better than competitor’s offerings.
Plaintiffs claim that the tailored message by Sanderson that makes use of claims of 100% natural and then attacks their direct competitors for advertising chicken that is “raised without antibiotics” gives Sanderson an increased market share.
