Class Action: San Pellegrino Lemon Sparkling Water Actually Does Not Contain Lemon
A latest class action lawsuit is accusing the company behind the San Pellegrino Lemon-flavored Sparkling Water of allegedly misrepresenting and falsely claiming that the said product contained more lemons than it actually has.
Maritza Angeles v. BlueTriton Brands Inc.
Filed in a New York court, the San Pellegrino Lemon Sparkling Water Class Action Lawsuit is contending that BlueTriton Brands, Inc. misled customers into believing that they are buying a product that has a respectable amount of lemons in them.
According to the case’s leading plaintiff Maritza Angeles, the company uses packaging that has a yellow tint in it to make the product look like it has more lemons.
Additionally, BlueTriton Brands, Inc. purportedly made use of the product’s actual name to bank on their consumer’s belief that they are buying a premium quality sparkling water product that has an appropriate amount of lemons in them.
Complainant Angeles cited the company’s potentially illegal marketing schemes to advertise their lemon-flavored sparkling water product. Per the plaintiff, the offering, officially named S. Pellegrino Essenza – Lemon & Lemon Zest, has the word ‘lemon’ in them, which offsets thinking in the everyday buyer’s mind that the product is made out of lemons.
Yet, the company that makes the product does not reportedly include the words ‘lemon and ‘lemon juice’ in the product’s packaging. Instead, they refer to the flavoring used as ‘natural flavors.’
In addition, the company’s use of yellow cellophane that encases the product packaging makes it seem that the product is much yellower in color than what it actually is.
Class Action Brief
As the class action suggests, BlueTriton Brands, Inc. violates the law by misleading product labeling.
Angeles stresses that she and others would not have bought the said product had she known early about the reality of the situation.
