Court Permits Pfizer Robitussin MS Anti-Cough Drug Class Action To Push On
The class action against the drug manufacturer Pfizer that is accusing it of knowingly tricking its buyers into thinking that they are buying a more potent cough syrup (Maximum Strength Robitussin Anti-Cough Syrup), although it only has a lower ingredients concentration, is allowed to move forward.
‘Maximum Strength’ Claims In Robitussin Drug Is Misleading
Although Pfizer has done a lot to have the charges dropped, the court decided that the legal merits of the Robitussin Maximum Strength Cough Syrup Class Action Lawsuit are permitted.
Penned by United States (U.S.) District Judge J. Paul Oetken, the decision said that Pfizer’s argument that everyday customers can cross-check and examine the ingredients between like drugs to compare their substance concentration is not reasonable enough.
Additionally, the judge upheld that the customers allegedly duped into buying the ‘Maximum Strength’ Robitussin anti-cough medication have suffered from monetary loss despite Pfizer’s counterarguments.
The Timothy Woodhams, et al. v. Pfizer Inc. Legal Case
The Robitussin Maximum Strength Cough Syrup Class Action Lawsuit is a legal case launched against the medicine industry behemoth by complainants Timothy Woodhams and Karmel Al-Haj.
Originally filed in an Illinois-based federal court, the first iteration of the legal accusations did not prosper due to the lack of personal jurisdiction of one of the plaintiffs.
Now, the Robitussin Maximum Strength Cough Syrup Class Action Lawsuit legal challenge is filed and being processed in New York. Woodhams and his peers want to form and represent a Class group consisting of Pfizer Maximum Strength Robitussin anti-cough medication buyers who were reportedly made to think that they are buying a more potent drug.
