Puff Bar Accused Of Misleading Customers Into Believing That Their Puff Bar Plus Vape Pens Can Last For Up To 800 Puffs
Vape pen maker Puff Bar is being accused of falsely advertising its Puff Plus vape pens as products that can give 800 puffs, when in fact, they can only last for a few hours.
Vape Company Faces Allegations Raised By Customer Turned Plaintiff
Based on reports, Puff bar is facing a possible nationwide class action litigation concerning the alleged fraudulent marketing of their product’s actual properties.
Filed in New York, leading complainant Jacobo Simkin contends that Puff Bar purportedly made use of deceptive claims about their Puff Bar Plus Vape Pens. The statement that the company’s vape pen offering can last for up to 800 puffs was dominantly placed for everyday customers to notice and fall for.
Nevertheless, Puff Bar Plus vape pens cannot actually last for 800 puffs, as its manufacturing company claims. In fact, the product can only last for a few hours of use.
Plaintiff Simkin claimed that he bought Puff Bar Plus after seeing and believing the statement saying the battery could last up to 800 puffs.
When he temporarily moved out of state, he continued on buying Puff Bar Plus vape pen. But all this time, he detailed that his purchases ended up not always lasting for 800 puffs as advertised by the company.
If asked as to why he continued on buying the product, Simkin claimed in his class action that he carried on patronizing the product for he believed that the earlier failures were only due to defective manufacturing. Yet, the continued product failures forced him to stop buying and stop believing in the product and the vape products company altogether.
Class Action Claims Puff Bar Is Also Liable For Other Alleged Misdeeds
Besides the alleged misleading product representations made by Puff Bar, the company is also charged for allegedly making their vape product readily accessible to very young audiences.
Because of the massive appeal of electronic cigarette or e-cigarette items towards the youth, the government and authorities attempted to ban them via regulatory restrictions.
However, Puff Bar purportedly took advantage of a legal loophole present in the rules, making it legally okay to sell disposable e-cigarette products to the youth. As a result, it catapulted them atop the sales charts of e-cigarettes and other related products.
The Puff Bar Plus Class Action Lawsuit is accusing the vape company Puff Bar of different charges ranging from not following The Magnuson-Moss Warranty Act to violations of different state trade statutes.
Complainant Simkin is asking the court to allow the certification of a nationwide class consisting of consumers all over the country who bought a Puff Bar Plus vape pen. Separate Florida and New York subclasses are also included in the proposal.
