Orgain Management Inc., the creators of Unsweetened Vanilla Almond Milk, had a class action lawsuit filed against them for their unlawful act of falsely advertising their product.
They claimed that it contains actual vanilla beans that provide the taste of vanilla when it does not.
The class action lawsuit shows that Orgain Management Inc. is being accused of deceiving their customers into purchasing their products by luring them in with their falsely labeled packaging that showcases the words “Vanilla” on the front label and the slogan “Our Commitment to Clean Nutrition” at the back which indicates that their product contains natural ingredients when it, in fact, does not.
Results from laboratory analysis presented in the official filing of the lawsuit revealed that the product did not show detections of compounds that are present in actual vanilla beans.
The ingredient list found on the back of the product’s packaging also reveals its flavoring to be from “Organic Natural Flavors” when it instead contains artificial flavors.
Therefore, the case is being conducted to expose Orgain Management Inc. for the unjust advances that have been made in their marketing strategy of providing false information to consumers about their product.
Plaintiff had entrusted Orgain Management Inc. to have produced their product with the use of actual vanilla beans as that is what is being interpreted based on the front label and slogan.
The product would not have been purchased had the consumer known that it contained artificial flavors that provided vanilla taste instead of organic flavor and actual vanilla beans.
The filing of the lawsuit states that “Consumers are entitled to know ‘whether the product [they are buying] is flavored with a vanilla flavoring derived from vanilla beans, in whole or in part, or whether the food’s vanilla flavor is provided by flavorings not derived from vanilla beans.”
Orgain Management Inc. has violated this statement as they did not abide by the rule of providing real information about the vanilla flavoring of the Unsweetened Vanilla Almondmilk.
Instead, the company’s design of the front label, with the word “Vanilla” and “Organic Natural Flavors,” has led consumers to believe that they are purchasing a milk product with a vanilla flavor derived from actual vanilla beans.
Moreover, the creators of the Unsweetened Vanilla Almondmilk are required to indicate in their ingredients list that the product contains not only “Organic Natural Flavors” but “Artificial flavors” as well because that is the truth behind the product’s flavor composition.
The Class is represented through the lawsuit consist of Oregon and California residents that have purchased Unsweetened Vanilla Almondmilk for their use from December 3, 2014, except Government officials, the defendant, Orgain Management Inc., and any individual related to the defendant.
