Coca-Cola is facing a lawsuit due to the allegedly deceptive and misleading labeling of the company’s Orange Vanilla Coca-Cola product. Read all about the Orange Vanilla Coke Lawsuit, here.
According to Plaintiff Louis Brienza of Chester, New York, the class action lawsuit filed last Oct. 18 asserts that the branding and packaging of Orange Vanilla Coca-Cola “are designed to — and does — deceive, mislead, and defraud consumers” of the undeclared ingredient which is an artificial vanilla flavoring.
Brienza bought Orange Vanilla Coca-Cola once in June 2020. According to him, he bought the product because of the front label claims. However, he didn’t expect that the taste was made from artificial vanilla flavors.
“The representations as ‘Orange Vanilla’ and ‘Orange Vanilla Flavored’ are false, deceptive and misleading because the product contains fake vanilla, not disclosed to consumers where they are expecting to see it on the front label,” the lawsuit argues.
Brienza asserts that had he known that the product contains artificial ingredients, he wouldn’t buy it at all.
The class action says that Coca Cola should use “artificially flavored” in the label because it is flavored with vanillin, instead of the real vanilla flavor made from the vanilla bean.
