Naked Juice. Co. faces a class action lawsuit due to alleged misleading and deceptive packaging. Ruby Harrisingh of Brooklyn, New York claimed that the Naked Juice Co. of Glendora Inc. has violated the state business laws. She said that the company committed negligent misrepresentations, fraud, and unjust enrichment by claiming in the label that its coconut water is pure even though it contains “other” flavors. Harrisingh initiated the class action on behalf of all customers who have purchased Naked Pure Coconut Water, without even knowing that it’s not pure.
FAUX Labeling: Not A Pure Coconut Water
Harrisingh added that the “pure” portion of the label was designed in bold type on a white background at the top of the carton. At the same time, the “other flavors” disclaimer was positioned near the bottom of the package. She said it’s “located amidst other label statements, above a background which makes identifying this statement difficult.”
“[Naked] misrepresented the substantive, quality, compositional and/or environmental attributes” of the coconut water, the class action lawsuit alleges.
“Reasonable consumers understand the term ‘pure’ to describe a food without any added ingredients,” the class action claimed.
“The value of the product that the plaintiff purchased and consumed was materially less than … represented by the defendant,” the Naked Pure Coconut Water class action lawsuit says. It goes on to insist that “had (the) plaintiff and class members known the truth, they would not have bought the product or would have paid less for them.”
