Medical Equipment Robocalls Class Action lawsuits have been filed against several companies for allegedly sending their consumers pre-recorded messages and telemarketing robocalls.
Consumers claim that they have received prerecorded messages, text messaging, or other telemarketing calls relating to the sale of medical devices and products without the prior written consent of the consumer which can violate the Telephone Consumer Protection Act (TCPA) that protect consumers against telemarketing. Medical devices and products include:
- Pharmacy products
- Wheelchairs
- Hearing aids
- Insulin pumps
- Scooters

The Telephone Consumer Protection Act (TCPA) is a method of protecting Americans from unwanted solicitation using technology. It prohibits most forms of robocalls, faxes, SMS text messaging, pre-recorded voicemails and call messages, and more, and is overseen by the Federal Communications Commission (FCC).
Telemarketers are banned from sending unsolicited text messages, calling or texting people without an established business relationship, failing to provide an option to opt-out of the communications, and more. Calls cannot be made to a residential telephone subscriber either before 8 a.m. or after 9 p.m. (called party’s local time). They also cannot be made to any residential telephone number on the National Do Not Call Registry.
