Marijuana Dispensary Violates TCPA
A recent Marijuana Dispensary Class Action Investigation has commenced as Marijuana dispensaries, on the whole, are becoming more common with more states legalizing the herb. Some dispensaries have been using radio ads, online advertisements, text messages, and other forms of communication to market and advertise.
The potential Marijuana Dispensary class action lawsuit would allege that marijuana dispensaries may have been ‘sending unsolicited text messages, ringless voicemails, robocalls, and/or using pre-recorded voices when contacting consumers without their consent’ which would form as a violation of the Telephone Consumer Protection Act (TCPA).

What the Telephone Consumer Protection Act (TCPA) is All About
The TCPA prohibits and regulates certain automated calls, texts, and faxes sent by telemarketers and businesses. It curbs unsolicited text messages, limits robocalls, and regulates ringless voicemails that are sent by companies to advertise deals and promotions. These forms of promotion and advertisement can be annoying and cause serious problems with consumers such as additional financial burden, tie up a text inbox, cause stress, invasion of privacy, clog up a consumer’s voicemail box, and miss important messages from genuine callers.
States that are included in the class action lawsuit investigation are:
- New York
- New Hampshire
