A New York class action is seeking to take Hercules Inc. to court for their alleged misrepresentation of its reloadable laundry machines cash cards’ true value, amongst other additional concerns.
According to plaintiff Abraham Libman, Hercules claims that its laundry cards are as good as cash though they only have limited use.
He continues that Hercules’s reloadable cash cards can only be used on a select number of machines limited to only a single residential building or dwelling.
Additionally, the plaintiff argues that the reloadable card refill options are only limited to a certain set of amount options and comes with an additional fee for the use of washers and dryers.
If a customer wants to reload their reloadable Hercules cash card, they can only choose between $10, $25, $50, and $75 options.
Plus, the company also charges added fees that can go as high up as $3.75 for the use of its dyers and washer machines.
As Libman puts it in the class action lawsuit’s court filing, this makes Hercules reloadable cash card a guarantee that it would never reach a balance of zero for each card.
If a customer wants to refund their remaining balance, the class action shares that Hercules forces the customer to pay up a $5 processing fee to have their request to be processed and given back to them.
The class action argues that the company allegedly computes the refund so that in the end, the customer’s reloadable cash card will have a remaining balance in it. This amount will then be kept by Hercules.
The Hercules Reloadable Cash Cards Class Action argues that these realities were not properly addressed and disclosed to Hercules cardholders by the company.
Filed in the United States District Court for the Southern District of New York, Libman is seeking to establish a Class consisting of all Hercules reloadable cash card owners all over the country who have fallen victim to the company’s malicious misrepresentation practices.
Additionally, a New York subclass of Hercules reloadable cash cardholders is included in the petition filed in court.
