Flipz White Fudge By DeMet’s Candy Company Do Not Have Enough Fudge, Actual Ingredients Used Reportedly Misrepresented By Manufacturer
The maker of the food snack White Fudge Covered Pretzels, DeMet’s Candy Company, is in a class action lawsuit after allegedly misrepresenting its Flipz White Fudges to customers.
Candy Manufacturer Accused Of Duping Customers
The Flipz White Fudge Covered Pretzels Class Action Lawsuit 2021 contended that DeMet’s Candy Company deliberately made efforts to make their patrons believe that they are buying a product that has fudge in it.
However, the plaintiff in the case, Jessica Spurck, contended that DeMet’s Candy Company’s Flipz pretzel products did not contain the right amount of fudge consumers expected them to have. Also, she pointed out that the company used vegetable oils in the fudge coating the pretzels.
She further stated that the fudge usually used in most sweets was made out of milk fat and other related materials such as butter.
DeMet’s Candy Company reportedly misled its consumers to think that the ingredient used in making their fudge is not vegetable oil but instead milk fat.
This substitution of ingredients greatly alters the product, Spurck claimed. It is said that its taste becomes waxy and it does not readily melt in a person’s mouth once consumed.
In fact, according to Spurck, Flipz White Fudge Covered Pretzels reportedly have more amounts of vegetable oils and the like compared to milk and others. It also makes the product cheaper to make; thus, the company was alleged to have made more than they are supposed to from their customers’ purchases.
Truth Was Hidden Under Plain Sight, Class Action Contends
The candy company was also accused of not being upfront about the fact. It is said that they only put the information about the fudge containing larger amounts of vegetable oil at the product’s back packaging.
The Flipz White Fudge Covered Pretzels Class Action Lawsuit is looking to form and represent a Class consisting of members from the state of New York who has bought the abovementioned product after believing in DeMet’s misrepresentation.
Spurck is also asking the court to hold the company accountable for its acts, pay up for the damages it may have caused, and cease its misleading product advertising altogether.
