Court Awards Class Certification To Class Members In Ohio Nuclear Power Plants Subsidy Legal Case

The judge in the District Court for the Southern District of Ohio has recently announced the decision in favor of the plaintiffs. 

Filed by Jacob Smith, the FirstEnergy Ohio Electricity Bills Surcharge Class Action Lawsuit argues that he and other residents in Ohio have to shoulder the burden of keeping the state’s failing nuclear energy facilities by paying extra surcharges on their monthly energy payments to FirstEnergy Corp. 

The FirstEnergy Ohio Electricity Bills Surcharge Class Action Lawsuit came after Ohio’s state legislative body passed a bill designed to cover the expenses of maintaining the upkeep of the David-Besse and Perry nuclear energy plants located within the state’s borders.

Later on, other class actions that have similar accusations with Smith’s case on top of added bribery claims were filed and fused with the initial legal action. 

It is said that Ohio state legislators received bribes amounting to $60 million in exchange for their approval of the controversial law. The former top leadership of the state lawmaking body has denied any wrongdoing. 

Nevertheless, Ohio’s State Governor Mike DeWine recalled the highly contentious law that led Ohioans to pay extra charges on their monthly energy bills. FirstEnergy Corp. has promised to pay a settlement fee amounting to $230 million so that its bribery charges be dropped.
