The Lowdown on Text Message Coupons and the Do Not Call Registry
Calling or sending text messages that contain advertisements and marketing strategies such as discount codes and coupons by businesses and organizations is a violation of the Telephone Consumer Protection Act (TCPA), which was enacted by Congress to limit telemarketing by businesses.
This particularly holds more weight when the numbers that were contacted were registered on the National Do Not Call Registry.
Several companies have been filed with lawsuits for violation of this law, including Abercrombie & Fitch (settled with $10 million settlement), Simply Fashion ($6.25 million class action settlement), and Sirius XM ($25 million class action settlement).
The Federal Trade Commission advised consumers to place their phone numbers on the National Do Not Call Registry to stop unwanted phone calls and text messages from companies for sales purposes.
