Coleman Faces Class Action Lawsuit Over Warranty Rights

According to a new class-action lawsuit, Coleman allegedly conducts unlawful and deceptive business methods to limit customers’ warranty claims and mislead them into believing they did not have warranty rights.

On July 2, lead Plaintiff Randy Scott filed a class action lawsuit in California alleging that Coleman’s parent company — Johnson Controls, Inc. — violates;

  • Song-Beverly Consumer Warranty Act
  • Consumer Legal Remedies Act, and
  • Unfair Competition Law

Scott asserts that Coleman misleads customers into believing they do not have warranty rights until they complete a product registration form and disclose personal information, a violation of the law.

The lawsuit states that customers do not have the warranties promised when they bought their products. They are required to register their warranties, a condition that was not mentioned at the time of purchase.

According to the class action lawsuit, Scott purchased a $3,790 DGAX Gas Furnace from Coleman on May 15, 2020, which was backed by the company’s express warranties. However, he later discovered that the equipment did not come with a warranty.

Instructions were included in the product’s package requiring Scott to register the product’s warranty online to access the warranty’s full benefits.

However, the online registration form and warranty registration card failed to inform him that they were intended for product registration purposes only. It was unable to specify that the warranty rights would not be forfeited if he did not complete and return the card or online registration form.

Not so Chill

The complaint states that Coleman exploits the personal information collected via warranty cards and online forms for its advertising and business objectives, as well as for its economic benefit.

Defendant does not have the right to gather personal customer information for these purposes via warranty registration.

According to California’s Song-Beverly Consumer Warranty Act, manufacturers who provide a warranty or product registration card or form must include statements informing customers that the card or form is for product registration and that failure to complete and return the card or form does not void the consumer’s warranty rights.

The company aims for its warranty registration cards and online forms to have a “chilling” effect on warranty claims by preventing customers who have not registered or choose not to register their warranties from submitting claims. By doing so, Defendant saves money on warranty repair and administration costs.

Scott seeks to represent anyone that has purchased a Coleman product in the state of California. He seeks class certification, damages, restitution, attorneys’ fees, costs, and a jury trial. In addition, he is charging for violations of:

  • California’s Song-Beverly Consumer Warranty Act
  • Consumer Legal Remedies Act, and
  • Unfair Competition Law
