
Coffee Mate Creamer Class Action Lawsuit 2021 – Fake “500 Servings” Claims From Nestle?

Nestlé USA and Walmart Faces Class Action Lawsuit Over Deceptive Advertising of Coffee-Mate Creamer
According to a Florida customer, Walmart Inc., and Nestlé USA overstates the serving size of Coffee-mate coffee creamer containers, which are marketed as having “500 servings” yet contain significantly less.
Julia Yonan v. Walmart, Inc., et al.
Julia Yonan is seeking to represent other Florida customers who believe Walmart and Nestlé misled them into purchasing packages of Coffee-mate that contained significantly less coffee creamer than advertised.
Plaintiff claims in the Coffee Mate Creamer Class Action Lawsuit 2021 filed in Florida that the companies deceive customers into paying more for certain Coffee-mate products by mislabeling them.
Yonan claims that she purchased the 35.3 oz canister of Coffee-mate creamer in February because of its 500-serving claim.
According to her, the package’s front label had a prominent statement claiming that the Nestlé product “Makes Over 500 Servings.”
The Coffee Mate Creamer Class Action Lawsuit states that a customer buying the product would reasonably believe that it includes at least 500 servings of powdered coffee creamer based on this prominent labeling and the serving size specified on the product.
False Bravado Over Coffee Creamer
The class-action lawsuit claims that Nestlé and Walmart could have avoided advertising the expected number of Coffee-mate servings on the items’ packaging or guaranteed that the labeling was accurate.
However, the Coffee-mate marketed at Walmart does not include anywhere near the 500 servings of powdered coffee creamer claimed. In addition, Yonan claims that she and other Florida customers would not have bought the product or spent as much on it had they known about the lie before.
Nestlé and Walmart are accused of violating Florida’s customer protection laws. Plaintiff is seeking to represent Florida residents that purchased Coffee-mate in 500-serving canisters.
She asserts that the companies should reimburse Class Members for the premium they paid for the mislabeled Coffee-mate creamers and discontinue misleading advertising.
The Coffee Mate Creamer Class Action Lawsuit filed in Florida is not the first to allege that Nestlé failed to indicate the number of servings in Coffee-mate products properly.
On July 13, 2021, an Illinois resident filed a class action lawsuit against Nestlé, alleging the company fraudulently labels items with nearly one-third fewer servings than advertised.
