Celsius Sparkling Orange Product Label Deceives Customers, Actually Contains “Lab Synthesized Ingredient” Lawsuit Contends
A class action lawsuit alleges that Celsius’s Sparkling Orange packaging label has purposely deceived customers into believing that it contains natural orange flavor, yet it is untrue.
According to online reports, the complaint argues that the beverage instead uses a “lab synthesized ingredient” to give Celsius’s Sparkling Orange its distinct taste.
Yet this was not stated in the product’s label and was just referred to as “natural flavor.”
This makes Celsius Holdings Inc., the company behind the Celsius Sparkling Orange product, transgress laws and must be held accountable for it.
For context, the company has made a name for itself in the fitness beverage industry as a company that offers products that are free of artificial ingredients such as preservatives and colors.
The complaint stresses that due to this, the company is “keenly aware of its [proper] labeling obligations” as prescribed by different rules and regulations.
Celsius Holdings Inc., however, chose not to abide by these labeling obligations and ended up mislabeling its Celsius Sparkling Orange product.
The class action continues that though the company claims that its Celsius Sparkling Orange is an orange beverage, it does not contain any orange products at all; thus, it should be labeled properly to inform consumers of its true nature.
Filed in the United States District Court for the Southern District of California, the class suit claims that the company has deceived, misled, and violated several California laws and federal statutes.
Jimy Ruiz, the plaintiff of the class action, is seeking to form a Class that includes all United States-based customers who have bought Celsius Sparkling Orange and other related products offered by Celsius Holdings Inc. allegedly containing misleading product labels.
