Old Navy Allegedly Underpaid Manual Workers

Old Navy paid hourly workers fortnightly when they should have been paid weekly, resulting in millions of dollars in underpayment to workers.

Jonelle Harris, the lead plaintiff, filed the Old Navy Workers Weekly Wages Class Action Lawsuit 1`against Old Navy, LLC on November 24 in a New York federal court, alleging violations of the state’s labor regulations.

According to the plaintiff, who worked as an hourly worker at Old Navy between 2018 and 2021, the retail giant has been underpaying her and other hourly workers for years.

The complaint seeks to collect underpayment and other damages for the plaintiff and similarly situated non-exempt hourly workers, such as sales representatives, who currently or have worked for Old Navy in New York State, the class action lawsuit states.

According to Harris, Old Navy paid her as well as other hourly workers in New York on a fortnightly basis.

Despite being manual workers, the company failed to pay them their earnings within seven calendar days of the end of the week during which they earned them, violating New York labor laws.

Harris was underpaid throughout the first seven days of each fortnightly pay period as a result of the defendant’s untimely wage payments, the lawsuit alleges. As a result, the defendant paid Harris on an irregular basis.

The Old Navy Workers Weekly Wages Class Action Lawsuit alleges that Old Navy’s failure to pay workers on time resulted in workers being underpaid.

Harris is seeking liquidated damages, fees, costs, and interest on the underpayments induced by untimely wage payments.

The amount in question surpasses $5 million, and the proposed Class of Old Navy Workers Weekly Wages Class Action consists of over 100 members, Harris adds.

She is seeking to represent anyone who has worked at Old Navy in New York on an hourly basis since November 24, 2015.
