Computer Tech Support Product Sales Give Way to Class Action Lawsuit
A number of computer tech companies were accused by the Florida Attorney General of misleading consumers into buying computer tech support products or services over the phone. The Computer Tech Support Class Action complaint accuses the companies of “posing as legitimate businesses,” and entering into merchant services contracts with information that distorted or obscured the “nature of their services and operations.” Banc of America Merchant Services LLC was also included in the complaint and was accused of providing payment processing services to the involved computer tech services.
Because of the services they provided, the bank was in violation of both the Telemarketing Sales Rule in Florida and the Florida Deceptive and Unfair Trade Practices Act.
The activities by the involved parties resulted in financial harm to consumers who were wronged by the scheme.
Computer Tech Support Class Action Settlement Details
Banc of America denies all wrongdoing related to the claims but has agreed to settle them with a $7.2 million settlement.
Consumers who paid for computer tech support products or services over the phone between March 1, 2015, and July 1, 2017, are eligible to recover a cash payment.
Refund amounts will depend on the number of filed valid claims but consumers will be compensated for the amount they paid for alleged computer tech support products or services. Valid claims must be filed no later than October 2, 2020. Consumers will be provided with a claimant ID number which will be sent via a notice from the Attorney General and used to file a claim online.
