Rauner Campaign Automated Calls Settles $1M Class Action Lawsuit

People from Illinois who received pre-recorded phone calls from the Bruce Rauner campaign may be eligible to receive $1 million as part of a class action settlement filed by Peter Garvey.

The Class Action Lawsuit

Between March 23, 2014, and May 13, 2021, the defendants placed or caused to send one or more phone calls or ringless voicemail messages to the Class Members – including any individual or entity residing in the United States – using a number assigned to a cellphone service with an automatic telephone dialing system or an artificial or prepared voice.

Peter Garvey, the lead plaintiff, contended that the Rauner campaign made these automated calls without seeking prior consent. This action violates the federal Telephone Consumer Protection Act (TCPA). 

The Rauner campaign is said to have made the calls since his first run for governor of Illinois in 2014, according to the Rockford Register Star report.

As per the National Governors Association, Bruce Rauner served as governor from 2015-2019. In addition, the Rauner campaign denies the allegation and maintains that it committed no wrongdoing but agreed to the Peter Garvey Settlement. The Court for the Northern District of Illinois has not ruled in favor of either party in this case.

Peter Garvey Settlement

The amount of every Class Member’s payment will be determined by the number of valid claims filed. After attorneys’ fees and other expenses are deducted, each Class Member will receive an equal portion of the settlement amount.

Claim forms may be submitted through mail or online via e-mail. Moreover, a final hearing for approval will be conducted on September 7, 2021.

Those who wish to withdraw from the settlement or object to it must do so by August 11, 2021. Whereas the deadline to file a claim is of the same date.
