Settlement Checks For The SiriusXM TCPA Class Action Lawsuit
SiriusXM received a class action lawsuit over calling customers for telemarketing even though some of them were on the National Do Not Call List Registry. Because of these allegations, SiriusXM agreed to pay $25 million for settlements.
SiriusXM Breaching Telephone Consumer Protection Act (TCPA)
SiriusXM allegedly sent telemarketing calls to their users even though the consumers were placed on the National Do Not Call List Registry. The plaintiff accused the company of violations of the Telephone Consumer Protection Act (TCPA). TCPA is a federal law that gives protection to customers from being harassed because of telemarketing practices.
TCPA was legislated to stop companies from violating people’s privacy and engaging in undesired and aggravating telephone solicitation. If the customers’ rights under TCPA are violated, they can collect settlements between $500 and $1,500 per call or text message.
In March 2017, Plaintiff Thomas Buchanan filed a class action lawsuit against SiriusXM. Buchanan claimed that the company called its customers to sell products despite being on the National Do Not Call List Registry and the company’s Do Not Call List.
SiriusXM agreed to pay $25 million to settle and give free three months of full access to the SiriusXM subscription package.
The SiriusXM TCPA Settlement will benefit all people who received calls from SiriusXM for over 31 days. Despite the settlements, SiriusXM did not accept any mistakes or wrongdoings on their end, but to end the class action lawsuit, they agreed to the settlement.
Claims of the Customers on the Lawsuit
The deadline for cash claims was October 8, 2019, and the deadline for free service was December 22, 2019.
People who received more than one telemarketing call from the company in 12 months between October 16, 2013, to April 26, 2019, despite being in the National Do Not Call Registry were qualified to file claims on these settlements.
Customers who claimed settlements received $12 or three months of free access to all subscription packages of SiriusXM radio.
On January 14, 2020, Class members in the class action lawsuit against SiriusXM radio asked the federal judge for the last approval of the settlement.
“Plaintiff respectfully submits that the robust number of claims speaks to the effectiveness of the notice plan, the ease and efficiency of the claims administration program, and the quality of settlement relief negotiated by Class counsel,” the motion for final approval argues.
