The satellite radio provider, SiriusXM, was sued for allegedly not honoring lifetime subscriptions. Consumers have claimed that SiriusXM’s lifetime subscriptions did not last the lifetime of the customer but rather the lifetime of the device that the customer first used to receive the service. The radio provider offered lifetime subscriptions for $357.54 to $755. The service subscription can be used up to four devices but with a transfer fee of $75 for each device transfer.

Settlement by SiriusXM Reaches $96M

SiriusXM contended that their lifetime subscription was consistent with its marketing but has agreed to pay the settlement.

Lifetime subscribers will be allowed to maintain their subscriptions for life, as opposed to a maximum of four devices according to the proposed settlement. Subscribers will also be allowed to transfer their lifetime subscriptions to an unlimited number of devices at the reduced charge of $35. Subscribers who no longer hold an active lifetime subscription will be able to reactivate it at no charge or claim $100 cash.

SiriusXM will also let inactive lifetime subscribers who choose the reactivation option to stream its service online, at no additional cost.

Furthermore, SiriusXM has agreed to pay for the settlement notice and administration, court-approved attorneys’ fees and expenses up to $3.5 million, and service payments for each named plaintiff and Paul Wright up to $5,000 each.

Active subscribers will automatically receive their benefits while inactive subscribers will need to submit a claim form for their benefits which will be submitted through the settlement website or by mail. If the inactive subscriber does not submit a claim form nor opts out, they will be subject to the settlement’s releases.

The Class Action consists currently of 964,000 members with 838,000 active subscribers and 126,000 inactive. Benefits of the settlement total to about $96.4 million.
