Class Action Alleged False Advertisements Over Samsung Galaxy Smartphone Speed

Samsung reached a settlement for the class action lawsuit accusing the company of misleading consumers with their advertisements that the Galaxy S4 has speeds faster than its real speed.

The class action claimed that the flagship phones were equipped with software that detects the use of benchmarking tests and circumvented it by increasing performance speed during the testing process. This resulted in false advertisement and misleading marketing claims about the phone line’s speed.

Consumers argued that this made the phone price significantly higher than it should be and consumers would not have purchased them had they known the true performance speed, thereby causing them injury.

This case is filed under the name: Daniel Norcia, et al. v. Samsung Telecommunications America LLC, et al., Case No. 3:14-cv-582-JD, N.D. CA.

Samsung Galaxy S4 Settlement Details

Samsung has denied the allegations but has agreed to settle the lawsuit with a $2.8 million settlement fund to avoid further costly and risky litigation process.

The settlement benefits consumers who purchased one or more 16 GB Galaxy S4 smartphones in California between April 1, 2013, and July 31, 2013.

Members of the class action lawsuit can expect payments of up to $10. Samsung has also agreed to require their manufacturers to confirm that software boosting performance speeds based on benchmarking applications will not be preloaded to future phones. Under the settlement, the company is required to guarantee this injunctive relief for three years.

Valid claim forms must be filed by class action members by November 9, 2020, with the Class Member ID they received with their settlement notice.

The deadline for exclusion and objection is set on November 23, 2020, with final approval hearing for the Samsung Galaxy smartphone speed settlement scheduled for January 28, 2021.
