A lawsuit was filed against Roundup Weed & Grass Killer because of the misleading labeling on their products where it says that the product targets an enzyme in plants but not people or animals, or something to that effect.
- Roundup Ready-to-Use Weed & Grass Killer III
- Roundup Ready-to-Use Weed & Grass Killer Plus
- Roundup Weed & Grass Killer Concentrate Plus
- Roundup Weed & Grass Killer Super Concentrate
What Else To Know About the Case
The case covers claims where Monsanto, Roundup’s manufacturer, misleadingly labeled Roundup products that it only targets enzymes in plants, but not ones in people or pets.
The lawsuit does not cover any injuries, only the labeling. The plaintiffs cite Monsanto as unfairly bettered, and their customers lost financially because of the products’ misleading marketing.
Monsanto did not admit to any wrongdoing but shelled out $39.5 million to have the lawsuit closed.
This amount covered the claims, awards to plaintiffs, attorney’s fees, and the promise that Monsanto will change its labeling strategies and wording on their products as stated in the agreement.
Updates To the Settlement
There were particular updates to the settlement.
If the total amount of the claims is less than the amount in the Common Fund, payments will then be raised to 10% of the weighted average retail price of the products claimed up to a value that will not go over 50% of the weighted average retail price of the products bought during the class period, which will be based on the statute of limitations in the class member’s state and is available on the Roundup settlement website, different from state to state.
If there are any class members who can’t provide proof of purchase, they will only be allowed a claim per unit per household per year within the allowed class period, although the Roundup Weed & Grass Killer Super Concentrate product is exempted, where claims are only up to 1 unit every 2 years.
Monetary awards will be as high as $53.15 in the settlement. Members can send a Claim Form online or by mail, and the extended claims deadline is on the 16th of February 2021.
Members who don’t want to be included in the settlement must do so also by the 16th of February 2021.
If any class members wish to object to the settlement, they must file on or before the 8th of March 2021, as the final hearing is set for the 11th of March 2021.
The Monsanto Company was an agrochemical and agricultural biotechnology corporation established in 1901.
In 2018, Bayer acquired the company and made it part of their crop science department. They developed Roundup, a glyphosate-based herbicide, in the 70s and was a major producer of genetically engineered plants.
