The Lawsuit Settlement
Hertz, a car rental company, has agreed to pay $200,000 in cash to resolve a class action lawsuit. It was filed in 2019 by a former employee who claimed that the company did not pay employees for working overtime.
The plaintiff, Polat K., alleged in the original lawsuit that he consistently worked more than 40 hours per week — usually between 50 and 60 hours — and that he was never compensated for any of those overtime hours, which was a violation of New York Labor Law.
Polat K. worked for Hertz in New York City from May 2013 until October 2015.
The parties filed court documents on May 24, 2021, requesting that the 2019 Hertz class action lawsuit be dismissed, citing the success of mediation efforts in the spring.
On May 29, 2020, the Court issued a stay in the case after Hertz filed for bankruptcy.
According to court documents, mediation in the case began on February 19, 2021, and the parties reached an agreement on March 24, 2021.
Furthermore, the settlement was authorized by a bankruptcy court on April 13, 2021.
Finally, both parties agreed to dismiss the original case filed in district court as part of the settlement agreement.
