Paychex $3.4M Class Action Settlement Over Biometric Privacy
Paychex has promised to pay about $3.4 million to compensate individuals in an Illinois settlement who utilized the company’s biometric time clocks.

The Class comprises any individual who scanned their biometric identifier — face, finger, iris, and other identifiers — into a Paychex time clock in Illinois between January 7, 2014, and May 28, 2021.
Paychex was sued in a class-action lawsuit for allegedly violating the Illinois Biometric Information Privacy Act (BIPA) for collecting biometric identifiers from individuals through a finger, iris, or facial scans without providing required written disclosures or receiving written consent.
According to its website, Paychex delivers payroll, human resources, and other services to over 680,000 customers in the United States and Europe. It also pays 1 in every 12 private-sector employees in the United States.
Paychex BIPA Settlement, 2021
Paychex maintains that it is innocent of all charges of wrongdoing but has accepted the settlement.
After attorneys’ fees and other expenses are removed, Class Members who make a valid claim will receive a specific percentage of the $3,375,519 settlement fund.
At the moment, the specific amount of each Class Member’s payout is unknown. It is based upon several criteria, including the total quantity of valid claim forms submitted.
The company has scheduled a final approval hearing on September 9, 2021.
All checks issued to members of the settlement class will expire and be voided 100 days after they are released.
Additionally, the attorneys who brought this lawsuit will seek attorneys’ fees equal to up to 35% of the settlement fund, plus reasonable costs and expenses, for the significant time, expense, and effort spent investigating the facts, prosecuting the case, and negotiating the settlement.
Moreover, the Class Representative will seek payment from the Court of up to $10,000 — for the time, effort, and service in this action.
Unless Class Members opt-out of the settlement, they will be prohibited from filing or continuing a lawsuit against Defendant or any of the other Released Parties involving any of the Released Claims.
The only method to obtain payment from this settlement is by submitting a valid and appropriate Claim Form.
By August 6, 2021, requests for exclusion from and objections to the settlement must be submitted. The last day to file a claim is on August 27, 2021.
