A class action lawsuit was filed against the New York Northwestern Mutual Life Insurance for allegedly issuing insurance fees based on how they paid their monthly premiums, which violated New York state law.
The lawsuit claims that a “$1 Northwestern Mutual Life Insurance fee was added to the premiums accounts holders paid by check rather than monthly scheduled electronic funds transfer,” which violated New York business law prohibiting fees based on payment by U.S. mail.
Consumers claimed that fees charged by the insurance company for mailing in premium payments were deceptive and misleading and that the company “committed deceptive acts or practices forbidden under New York business law.”
The law enacted in New York served to protect those who have no internet access in their homes or who are uncomfortable using the internet, specifically senior citizens who are concerned about their privacy. It noted that tacking on fees for customers who prefer paper billing statements or to pay bills by mail greatly affects low-income populations.

Details on the N.Y. Northwestern Mutual Life Insurance Fees Settlement
N.Y. Northwestern Mutual Life Insurance refuses to admit all allegations but has agreed to resolve the claims with a $595,000 settlement to end the class action lawsuit.
The settlement applies to individuals with a New York mailing address who were charged an additional rate or fee by Northwestern Mutual Life Insurance Company between June 21, 2016, and May 28, 2020.
Settlement award will be calculated as such:
- Class action member awards will be determined by calculating the total service charges assessed by Northwestern Mutual between June 21, 2016, and May 28, 2020, for mailed premium payments.
- The amount will be subtracted from the settlement amount and divided between all the class action members.
- Current account holders will automatically receive a credit award.
- Class action members with closed accounts will receive a check if they submit a valid claim form on time.
Valid claim forms must be filed by class action members with closed accounts and submitted by November 20, 2020 either online or by mail and accompanied by additional information and a Claim ID Number which will be available on the settlement notice received by the class action member.
The deadline for exclusion or objection has passed and was set on August 3, 2020. The final hearing is scheduled for October 6, 2020.
