Muscle Milk Class Action Settlement
Cytosport faced a class action lawsuit after making misleading advertisements about their products. Moreover, the Muscle Milk Class Action has now been resolved and plaintiffs managed to secure a $12 million settlement.
“After a hard-fought litigation including multiple rounds of written discovery, depositions, expert discovery, extensive motion practice, and two rounds of mediations, Plaintiffs and Defendant reached a Settlement,” reveals the plaintiffs’ motion for preliminary approval of the settlement.
“Compared to the Plaintiffs’ initial estimates, the individual recovery offered under this Settlement could exceed the amount Class Members could reasonably expect at trial. Accordingly, this Settlement provides a significant and immediate benefit to the Settlement Class.”
What You Need to Know About The Muscle Milk Class Action Settlement
The recent Muscle Milk Class Action asserts that Cytosport made false and misleading statements about the protein and fat content on its numerous products. The lawsuit pointed out that the company labeled their products with “lean” despite the absence of ingredients to back up their claims.
According to reports, the products included are Muscle Milk: Lean Muscle Protein Powder, Muscle Milk Light: Lean Muscle Protein Powder, Muscle Milk Naturals: Nature’s Ultimate Lean Muscle Protein, and others.
Furthermore, the defendant also advertised the Muscle Milk’s protein content falsely, the original complaint stated. Cytosport reportedly declared that its products have L-Glutamine, an amino acid. But the plaintiffs argued that there is no substance found in “any appreciable amount” in the products.
Due to their false advertising, Cytosport is obliged to pay Class Members according to the type of product and its costs.

The Settlement’s Two Classes: The Shake Class and The Powder Class
The Shake Class includes:
All US consumers who bought any of the following products between Jan. 23, 2011 (Jan. 23, 2009 in Michigan) and May 5, 2020:
- Cytosport Whey Isolate Protein Drink;
- Monster Milk: Protein Power Shake;
- Genuine Muscle Milk: Protein Nutrition Shake;
- Muscle Milk Pro Series 40:
- Mega Protein Shake
Eligible Class Members will receive $1 per purchased Class Product, subject to pro-rata adjustment. For Class Members with no proof of purchase, they will be entitled to a maximum claim of $25. However, if you’re a Shake Settlement Class Member with proof of purchase, there will be no cap.
The Powder Class includes:
All US consumers who bought any of the following powder products with the phrase “lean lipids,” “lean protein,” “lean muscle protein,” or “new leaner formula” on the label:
- Muscle Milk: Lean Muscle Protein Powder;
- Muscle Milk Light: Lean Muscle Protein Powder;
- Muscle Milk Naturals: Nature’s Ultimate Lean Muscle Protein;
- Muscle Milk Gainer; High Protein Gainer Powder Drink Mix;
- Muscle Milk Pro Series 50: Lean Muscle Mega Protein Powder;
- Monster Milk: Lean Muscle Protein Supplement between Jan. 23, 2011 and Dec. 31, 2018
Eligible Class Members will receive $3 for each purchase of a product weighing 2 ¾ lbs. or less and $5 for each purchase of a product weighing more than 2 ¾ lbs. For Class Members with no proof of purchase, they will be entitled to a maximum claim of $25. However, if you’re a Shake Settlement Class Member with proof of purchase, there will be no cap.
