What Led to the Mike and Ike Class Action Settlement News?

Candy manufacturer of Mike and Ike and Hot Tamales, Just Born, battled a class action lawsuit over deceptive packaging. There is now a Mike and Ike Class Action Settlement, and Hot Tamales Class Action Settlement, now available.

Consumers claimed that the popular products come in cardboard boxes that conceal the under-filling of the product packaging.

Consumers cannot see how much product the packaging really contains and are thus allegedly misleading. Consumers would not have purchased the products had they known how much they were actually getting.

The Mike and Ike and Hot Tamales packaging violated various laws which included California’s False Advertising Law, California’s Unfair Competition Law, California’s Consumer Legal Remedies Act, and more.

Details on the Mike and Ike and Hot Tamales Class Action Settlements

Just Born denied any wrongdoing and allegations in the class action lawsuit but has agreed to pay $3.3 million in settlement, with both sides agreeing to the settlement to avoid the risk of continuing litigation.

The settlement benefits consumers who purchased one or more cardboard boxes of Mike and Ike and/or Hot Tamales candies between Feb. 3, 2013, and July 23, 2020.

Class Action members can choose to receive either cash payments or a voucher for free candy, but not both. Cash payments are distributed at a rate of around $0.50 per purchased product but may be adjusted higher or lower depending on the number of valid claims filed.

Vouchers of one free box of Hot Tamales or Mike and Ike candies are available for every two boxes purchased and are capped at up to eight free boxes of candy.

Valid claim forms must be filed by Nov. 10, 2020. The deadline for exclusion and objection is Oct. 11, 2020. The final approval hearing for the Mike and Ike Hot Tamales class action settlement is Dec. 15, 2020.
