Madison Heights, Michigan, $2.6 Million Class Action Settlement Over Stormwater Fees

Madison Heights, Michigan, residents who paid stormwater charges may be able to receive a $2.6 million compensation from a class action settlement.

Who is Included in the Class

All property owners and residents in Madison Heights who experienced or paid stormwater charges to the city between July 1, 2016, – June 30, 2021, are included in the Madison Heights Stormwater Class.

The plaintiffs in a class action lawsuit had disputed the city’s required stormwater service charge, claiming it was not a valid usage fee but rather an unlawfully imposed tax.

Madison Heights has vigorously denied all charges of wrongdoing; the Court has not decided in favor of either side in this matter.

United States Census Bureau indicates that the city had a population of roughly 30,000 people on July 1, 2019.

Madison Heights Stormwater Settlement — 2021

The settlement will credit the accounts of ongoing water, sewer, or stormwater users of the city with a proportional amount of the settlement fund.

Any Class Members who had unpaid amounts for water, sewer, or stormwater bills that were more than 30 days unpaid as of June 30, 2021, will have their credits decreased by the amount of the past-due balance.

Those who are no longer Madison Heights water, sewer, or stormwater customers and who wish to obtain a cash return if they are qualified must submit a written claim form to the City of Madison Heights.

For each Class Member, the amount of their contribution will be calculated by adding up all charges they made during the Class Period and dividing this figure by the total amount of payments Madison Heights obtained from Class Members during that time period. The resulting amount will be adjusted by the quantity of the net settlement fund to arrive at the final figure.

The final approval hearing for this Madison Heights Stormwater Settlement will be held on December 1, 2021.

The deadline for filing a claim, opt-out, or object to the settlement is October 2, 2021.
