JBS $20M Class Action Settlement Over Alleged Pork Price Control
JBS USA Pork, a pork producer, has consented to a $20 million settlement that will benefit indirect pork product customers in the United States.
In re: Pork Antitrust Litigation
Between Jan. 1, 2009, and Apr. 2, 2021, the Class comprises any person or business that indirectly purchased pork for personal consumption in the United States from any of the defendants or any “co-conspirator” or their affiliates or respective subsidiaries.
Each Class Member is a member of the Class on a national level. However, under the settlement conditions, only those who reside inside the following jurisdictions are entitled to payment:
- The District of Columbia
- New Hampshire
- New Mexico
- New York
- North Carolina
- North Dakota
- Rhode Island
- South Carolina
- Virginia, and
- West Virginia
This agreement exclusively settles claims against JBS.
According to the plaintiffs’ class action case, the defendants and others conspired and agreed to fix, increase, keep, and stabilize the pricing of pork products to inflate pork prices in the U.S., in violation of federal and state law.
The term “indirect purchasers” refers to those who acquire a good or service from a source other than the defendant or any of their suspected co-conspirators, such as a store or wholesalers.
In this case, the court has not decided in favor of any party, and both parties have agreed to the settlement.
According to the company’s website, JBS is the second-largest producer of fresh pork in the United States. JBS operates facilities that can process 92,000 pigs a day.

While Class Members are already able to file claims, no funds will be given until the class action case against the remaining defendants is resolved.
The amount of money that each Class Member who submits a valid claim is unknown at this time.
Payments will be determined by many factors, including the number of valid claims submitted.
Attorney’s fees and other charges approved by the court will be taken from the $20 million settlement amount.
Additionally, JBS has agreed to assist with the plaintiffs’ ongoing prosecution of the class action lawsuit under the terms of the settlement.
Class Members in the settlement who take no action will continue to be Class Members and will be awarded under the settlement terms. They will also have the option of participating in or opting out of any future settlements or judgments won by the plaintiffs in this case.
On Nov. 29, 2021, the court will conduct a fairness hearing in the settlement.
The deadline to withdraw out of the settlement or to object to it is Oct. 20, 2021.
The claim form is provided on the settlement’s website; there is currently no deadline.
