What to Know About the Horizon Solar Power Settlement

Horizon Solar Power battled a class action lawsuit that accused the company of violating the Telephone Consumer Protection Act (TCPA) with unsolicited telemarketing calls.

The calls that came from the company allegedly used an automatic dialing system and prerecorded messages and were done without consumer consent.

According to the class action lawsuit, the company used such a system as it allows for “thousands of automated calls to be placed at one time” compared to using telemarketing representatives who could only call each customer one at a time. This shifts the burden of wasted time to consumers.

Under the TCPA, businesses are required to obtain express prior written consent before sending consumers automated telemarketing calls, texts, or faxes and include communications sent using an automatic dialing system and/or a prerecorded message.

Settlement Details

Horizon Solar Power has denied any wrongdoing but has agreed to resolve the claims with $800,000 in settlement funds.

The class action settlement benefits consumers who received unsolicited telemarketing calls from Horizon Solar Power between the period of October 16, 2017, and December 8, 2017.

The settlement fund will be distributed on a pro-rata basis with affected consumers in the class action receiving a proportionate share. The exact payment amount will depend on the number of claims filed and the net of the fund after deduction of fees and costs.

Remaining uncashed settlement checks may be used for future payments, moving forward only when claims are more than $5 per claimant.

Valid claim forms must be submitted by December 9, 2020.

The deadline for exclusion and objection is set for December 9, 2020. The final approval hearing is scheduled for January 15, 2021.
