Checkers Settlement Date Extended – Checkers TCPA Class Action Lawsuit’s Claims

Deadline Of Filing Claims in Checkers Text Coupon Class Action Extended

If you have missed out on the deadline to file a claim in the Checkers Text Coupon class action settlement, you can still file a claim now after it has been extended to March 15, 2021. 

This comes after the initial Class notice only tallied to less than one percent of the projected Class Members to this particular class action.

It was expected to benefit more than 1.89 million people, but the company was only able to receive more than seven thousand claims. 

They were initially notified via email that was identified with the affected mobile numbers, with others ended up being sent via mail because they could not reach the intended recipient. 

Because of this, the judge sitting on the case has ordered Checkers to reach out to affected individuals via a supplemental text message to notify them of their claims.

This applies to those who have applied for a claim and to those who did not do so.

Fearing that it would run counter to the law, the company contested the decision, but the judge turned it down, stating that the move is necessary because people check their texts more often than their email inbox. 

The settlement is a result of a class action lawsuit filed against Checkers alleging that the company has violated provisions of the Telephone Consumer Protection Act or TCPA.

This was allegedly done by sending text messages using an auto-dialing system to its clients without asking for their express consent. 

To be eligible for a compensation of two $5 in-store vouchers, Checkers customers are asked to submit the phone numbers they have used between December 21, 2013, to March 8, 2019, in their claim. 

No proof of purchase is required, and you can file a claim via the settlement’s official claim site here.
