Checkers Data Breach Class Action Settlement
Checkers and Rally’s eventually lost a Class Action Lawsuit after the company mishandled a data breach about a year ago. As a result, 100 restaurant locations all around the country from 2015 to 2019 were affected. According to reports, the Checkers Data Breach remained undetected which exposed consumer payment information including card numbers, verification codes, expiration dates, and more. The plaintiffs asserted that it’s the responsibility of Checkers and Rally’s restaurants to know the risks of data breach issues because of the increasing threat from hackers.
Moreover, the Checkers and Rally’s class action lawsuit stated, “despite all of this publicly available knowledge of the continued compromises of personal information in the hands of other third parties, such as national restaurant chains, [Checkers’] approach to maintaining the privacy of [customer information] was lackadaisical, cavalier, reckless, or at the very least, negligent.”
Due to this apparent negligence, a lot of consumers information has been compromised, making the information more vulnerable to theft and fraud.
Despite these allegations, Checkers and Rally’s denied any wrongdoing. However, they agreed to a settlement. Through this deal, the restaurant can take action in the allegation.
The settlement entitles eligible Class Members for up to $5,000 in reimbursement for documented out-of-pocket expenses and lost time. The expenses cover bank fees, fraudulent charges, and more. For the lost time, this could be counted as the time spent mitigating the effects of the data breach. The lost time will be reimbursed at a rate of $20 per hour, up to 4 hours.Contact Us
