Big Fish Casino Class Action Settlement Over Illegal Gambling Operations

Big Fish Casino has agreed to pay $155 million to resolve two class-action lawsuits brought against it. Cash payments will be made in varying amounts based on the amount spent on in-app purchases.

Manasa Thimmegowda, et al. v. Big Fish Games, et al.

Anyone who played Big Fish Casino, Jackpot Magic Slots, or Epic Diamond Slots on or before August 31, 2020, is covered by the settlement.

Plaintiffs in the class action lawsuits against Big Fish Casino said that the online gaming platform constitutes illegal gambling given the nature of the games. Users purportedly wager real cash on these games via in-app purchases.

As a result, the plaintiffs assert that these games violate Washington’s gambling laws.

The Big Fish Casino class action lawsuit states that the defendants’ online gambling games are illegal because they are games in which players gamble money (the chips) and can receive additional entertainment and gameplay (by winning additional chips) through an element of chance (e.g., by spinning an online slot machine).

Manasa Thimmegowda, one of the plaintiffs, stated that she began playing Big Fish online casinos in November 2017. She is believed to have lost more than $3,000 since then through in-app purchases.

She contended that Big Fish Casino used the same illicit gaming operation to defraud thousands of clients. In 2017, the operator allegedly earned more than $3.8 billion through free-to-play “gambling” games.

According to the complaint, these earnings are generated mostly through in-app purchases.

Thimmegowda stated in her class action case against Big Fish Casino that the Defendants violated Washington law by operating Big Fish Casino as well as other identical online gambling games, illegally profiting from thousands and thousands of consumers.

Big Fish Casino Settlement, 2021

Big Fish Casino did not admit any wrongdoing but has offered to pay a $155 million settlement to address the charges against it. The agreement assures that plaintiffs and Class Members can collect damages while also eliminating the costs and hazards associated with a trial.

Cash payments are made according to the amount played on Big Fish Casino games under the settlement agreement. Settlements range between $7.50 – $100,000, depending on the amount spent by each Class Member and the number of claims submitted to the settlement administrator.

The settlement website includes a recovery calculator to help Class Members determine how much they may get.

Claimants must file a valid claim by January 4, 2021, to be eligible to benefit from class action settlement. Although no evidence is necessary to receive compensation under the settlement, Class Members may be asked to supply data about their Big Fish Casino account.

Exclusion and objections were due by January 4, 2021. The Big Fish Casino settlement’s final approval hearing was planned for February 11, 2021.
