Barry University Tuition Refund Lawsuit Ends in a Settlement
A settlement agreement has been reached in the Barry University Tuition Refund Class Action lawsuit totaling $2.4 million. The lead plaintiff Marlena Rosado initially claimed that the school did not reimburse the tuition to the students, along with other fees, after the campus closed in Spring of 2020 because of the covid-19 pandemic restrictions.

Details of the settlement
According to the settlement, 6,000 eligible class members may receive about 60% of their estimated recoverable damages from Barry University. District Judge Jose E. Martinez stated that the settlement was a good choice.
Barry University will need to put the $2.4 million in a common fund for the members who were in school during the class period or who made payments for a student.
Members may choose between receiving their settlement in the form of cash payments, tuition credits, or credit for any unpaid balances they may still owe to Barry.
Before the settlement, the court denied Barry’s request to dismiss an amended version of the class action lawsuit because the problem was whether Rosado properly alleged unjust enrichment or breach of contract.
The settlement, according to the settlement order, was reached after a month of mediation.
Students at the University of Florida filed a similar class action lawsuit last month claiming that they should be reimbursed for having to shift to virtual learning because of the COVID-19 restrictions.
