Apple Sued over Defective PowerBeats; Settlement Now Available
It has hit news stands that Apple has settled its PowerBeats Class Action Lawsuit over the Cupertino company’s product, the PowerBeats 2 headphones, as defective when it stops working and fails to retain charge after “minimal usage.”
Apple has allegedly deceived consumers with the product’s durability and sweat-resistance, as well as replaced returned earphones that are eligible for their one-year warranty program with products that has the same flaws.
The settlement comes after a lawsuit was filed in 2017 that alleged the earphones were “shoddy” and that Apple has falsely advertised the Powerbeats 2 as a product that was “built to endure.”
The lawsuit claims that “Apple continues to promote and market its faulty PowerBeats and continues to profit handsomely from their sale. In so doing, Apple has defrauded the public and cheated its consumers.”

Apple has denied any wrongdoing and all allegations but has agreed to pay $9.75 million, which will be split between class members after attorneys’ fees and other costs, to avoid tedious and costly litigation.
The settlement proposal uses a point-based system to allot funds for claimants and awards more points to those who can supply more evidence in support of their claims, such as proofs of purchase and records of warranty repairs or replacements.
Those who purchased the new PowerBeats 2 earphones before August 7, 2020, are entitled to claim payment from the settlement, after receiving final approval from the court. Claim forms must be submitted by November 20, 2020, and can be done so online or via mail.
Preliminary approval was granted to the deal by the presiding court in California’s Santa Clara County, with its final approval to be delivered on January 21, 2021, at which claimants can air any objections.
